MyHappyHour.co.ke General Terms and Conditions

By accessing MyHappyHour.co.ke, placing an order, or booking an experience, you agree to be bound by these General Terms and Conditions and all referenced Sub-Policies listed in Section 5.

Acceptance and Eligibility

1.1 Legal Drinking Age (Kenya Law)

By using this site, you warrant that you are 18 years of age or older, which is the legal drinking age in Kenya.

1.2 Age Verification
  • We reserve the right to request a valid National ID or Passport from the recipient upon delivery.
  • Mandatory Protocol: Our delivery personnel are required to follow a mandatory, non-negotiable protocol which includes visually verifying the recipient’s age against a government-issued ID upon arrival.
  • If the recipient fails verification or is visibly intoxicated, the delivery will be cancelled. A partial refund (less a delivery and restocking fee of up to 20% of the order value) will be issued.
1.3 Responsible Drinking

MyHappyHour.co.ke advocates for responsible drinking.

  • We reserve the right to set and enforce reasonable maximum quantity limits on orders.
  • Our delivery staff are authorized to refuse delivery if the recipient is visibly intoxicated or displays unsafe behaviour./li>
  • We shall not be held liable for any misuse of the products or any resultant harm, damage, or incident.
1.4 Order Placement and Acceptance

Your order is an offer to purchase. The contract is formed only when we send you a confirmation (via email/SMS) that your order has been accepted and dispatched.

2. Ordering and Payment

2.1 Pricing and Currency

All prices are listed in Kenyan Shillings (KES) and include applicable taxes (VAT) unless otherwise stated.

2.2 Payment Methods

We accept payments via M-Pesa and major credit/debit cards (Visa/MasterCard) only. Cash on Delivery (COD) is currently not accepted.

3. Disclaimers and Liability

3.1 Limitation of Liability
MyHappyHour.co.ke shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our service or products.
3.2 Indemnity

You agree to hold MyHappyHour.co.ke harmless from any claims, damages, or costs arising from your breach of these Terms, your misuse of the service, or your violation of any law or the rights of a third party.

4. Governing Law and Dispute Resolution

These Terms and your use of the site are governed by the laws of Kenya. Any dispute shall be subject to the exclusive jurisdiction of the Courts of Kenya.
